What to Do if You Are Arrested in Singapore?



It is vital that we know our rights under the Criminal Justice System in Singapore to protect ourselves if we are arrested regardless of it being rightfully so or not.

If you are arrested by the police, you should first ask the police for their identification and the reason for your arrest. Thereafter, the police may detain you for a maximum of 48 hours after which they will need to bring you before a judge if they intend to remand you further. Bail may be granted by the police or the courts at any point in time during this period.


During the period of detention, it is highly likely that the police will take your statement and ask you to sign to verify it. It is essential that you read through your recorded statement carefully to pick up any discrepancies or any statements which carry a meaning you did not intend to convey. You should ask to amend them before signing on your statement. You could also choose to remain silent but an adverse inference may be drawn and guilt may be inferred if the accused remains silent and does not state his defence, if any at the earliest possible time.

You should also request for access to counsel- a Singapore Criminal Lawyer at the earliest possible time. It would be immensely beneficial if you could consult a Criminal Law Specialist during your arrest to render you with legal advice and to point out the most appropriate course of action that you should take.

If charges are eventually brought against you, you should seek a lawyer who practises Criminal Law in Singapore to represent you regardless if you choose to claim trial or to plead guilty as you may be able to achieve a more desirable outcome than if you proceed without legal representation.
